These terms are a legal agreement between you and Master of None Ltd, a company registered in England and Wales (company number 16192559), registered office 29a High Street, West Wickham, England, BR4 0LP (“Topflight”, “we”, “us”, “our”). They govern your use of the Topflight game at play.topflightff.com (the “Service”).

By creating an account or using the Service, you agree to these terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 16 years old to create an account and use the Service. By using the Service you confirm that you are 16 or over and that the information you give us is accurate.

2. Your account

• You are responsible for keeping your login details secure and for all activity that happens under your account.
• Tell us promptly at hello@topflightff.com if you think someone else has accessed your account.
• You may not share, sell or transfer your account, or create an account using someone else’s identity.

3. What Topflight is

Topflight is a free-to-play fantasy football game built around a live auction draft, played in private leagues with people you invite.

It is important that you understand the following:

• Topflight is free to play. There are no entry fees, no stakes and no in-app purchases.
• The auction uses an in-game virtual budget only. This budget has no monetary value, cannot be bought, sold or exchanged for money or anything of value, and cannot be withdrawn.
• Prizes are limited to in-game recognition (such as digital trophies and, for eligible leagues, a printed almanac). These have no cash value and cannot be exchanged for money.

Topflight is a game of skill for entertainment. It is not a gambling or betting product, and no real money is ever wagered, won or lost.

4. Fair play and acceptable use

When using the Service, you agree that you will not:

• choose a team name, or post content, that is offensive, abusive, hateful, harassing, obscene, or that infringes anyone’s rights;
• impersonate any person or misrepresent your connection with anyone;
• cheat, exploit bugs, use bots or automated tools, or otherwise interfere with the fair operation of leagues, auctions or scoring;
• attempt to disrupt, damage, gain unauthorised access to, or reverse-engineer the Service;
• use the Service for any unlawful purpose.

Leagues may have a chairperson with tools to manage their league (for example, managing teams and squads). League members are expected to play in good faith. We may remove content, rename teams, or suspend or close accounts that breach these terms.

5. Football data

Live football data (fixtures, results, player statistics and similar) is provided by third parties. We work to keep it accurate and timely, but we do not control it and cannot guarantee it is always complete, accurate or up to date. Scoring depends on this data and may occasionally be adjusted to correct errors.

6. Availability

We want the Service to be available and reliable, but we provide it “as is”. We do not guarantee that it will be uninterrupted, error-free, or available at any particular time. We may change, suspend or withdraw features, or carry out maintenance, and we will try to minimise disruption where we can.

7. Our intellectual property

The Topflight name, brand, design, software, and all content we provide (other than third-party football data and your own content) belong to Master of None Ltd or our licensors. You may use the Service for your own personal, non-commercial enjoyment. You may not copy, adapt, distribute or commercially exploit any part of it without our permission.

8. Your content

You keep ownership of the content you create, such as your team names. By submitting it, you grant us a licence to use, display and store it as needed to operate the Service. You are responsible for making sure your content does not break these terms or infringe anyone’s rights.

9. Suspension and termination

You can close your account at any time. We may suspend or close your account, or restrict your access, if you breach these terms, if we reasonably believe it is necessary to protect the Service or other users, or if we stop providing the Service. Sections that by their nature should survive termination (such as intellectual property and liability) will continue to apply.

10. Our liability

Nothing in these terms limits liability that cannot be limited by law (such as for death or personal injury caused by our negligence, or for fraud).

Subject to that, because the Service is provided free of charge for entertainment:

• we are not liable for any loss that is not a foreseeable result of our breach, or for any business losses; and
• we are not responsible for the accuracy of third-party football data or for events outside our reasonable control.

If you are a consumer, you have legal rights that these terms do not affect.

11. Changes to these terms

We may update these terms from time to time. If we make significant changes, we will let you know through the Service or by email. Continuing to use the Service after changes take effect means you accept the updated terms.

12. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales will have jurisdiction, though if you live elsewhere in the UK you may bring proceedings in your own jurisdiction.
